Magic Commerce Inc. (doing business as "MagicCo," "we," "us," or "our") is an artificial-intelligence and digital-technology company based in Florida, United States. We provide AI consulting, website and software development, automation solutions, AI-powered applications, digital commerce infrastructure, digital marketing, hosting-related services, and business technology consulting.

This Privacy Policy describes how we collect, use, disclose, and protect information about you when you use our Services. In this Policy, "Services" means our websites (including magicco.ai), applications, APIs, customer portals, AI assistants (including our AI Receptionist), software platforms (such as MagicAuth, MagicOps, MagicBrief, MagicProperties, MagicIntel, MagicAudience, and MagicVote), and related digital services operated by Magic Commerce Inc., unless a different privacy policy is expressly provided for a specific product or engagement. By using the Services, you agree to this Policy. If you do not agree, please do not use the Services.

1. Information We Collect

1.1 Information You Provide Directly

  • Contact and business information — such as your name, email address, company name, role, and any other details you choose to provide when you contact us at hello@magicco.ai, submit an inquiry, or register for a Service.
  • Chat and assistant interactions — messages, questions, and any information you type into our AI assistants, including business details you choose to share about your project or company.
  • Client content — files, data, code, or other materials submitted in connection with a Service or engagement, which are processed as described in Section 7 (Confidentiality and Intellectual Property) and in any applicable written agreement.

1.2 Information Collected Automatically

  • Usage and analytics data — pages visited, features used, time on page, referring URLs, approximate location (derived from IP address), browser type, operating system, and device information. We may use first-party analytics and carefully selected third-party analytics providers to understand how visitors use the Services.
  • Identifiers — a randomly generated visitor identifier stored in your browser's local storage (see our Cookie Policy) used to distinguish visits.
  • Log data — IP addresses, request timestamps, and technical events recorded by our servers for security and reliability purposes.

1.3 Sensitive Information

We do not knowingly collect payment card data, government identification numbers, or sensitive categories of personal information through our public website. Please avoid submitting confidential, proprietary, export-controlled, attorney-client privileged, health-related, financial-account, or otherwise regulated information through the AI assistants or public forms unless specifically requested under a signed agreement.

2. Automated (AI) Processing

Our AI assistants and AI-powered features are operated by artificial-intelligence systems. When you interact with them:

  • Your inputs are processed automatically by AI models. We may use trusted AI service providers — such as Anthropic, OpenAI, Google, or similar providers — solely for the purpose of generating responses or delivering requested Services, under contractual confidentiality and data-protection obligations.
  • Conversations may be logged and reviewed by our team to respond to your inquiry, ensure quality, maintain safety, and improve the Services.
  • We do not use your conversations to train publicly available AI models.
  • We do not use automated decision-making that produces legal or similarly significant effects about you without human involvement.

2.1 AI Accuracy Disclaimer

AI systems may occasionally produce inaccurate, incomplete, or outdated information ("hallucinations"). You should independently verify important information before relying on AI-generated responses. AI-generated responses are provided for general informational purposes only and do not constitute legal, accounting, tax, engineering, medical, cybersecurity, financial, or other regulated professional advice, and do not create any contractual obligation or commitment by Magic Commerce Inc. (see our Terms of Service).

3. How We Use Your Information

  • To provide, operate, maintain, secure, and improve the Services;
  • To respond to your inquiries and communicate with you about potential or ongoing engagements;
  • To understand how visitors use the Services (analytics);
  • To detect, prevent, and address fraud, abuse, security incidents, and technical issues;
  • To comply with legal obligations and enforce our agreements.

4. Business and Organizational Users

The Services are designed primarily for business audiences. If you interact with us on behalf of your employer or another organization, your information may be processed in connection with that business relationship, and the terms of any written agreement between Magic Commerce Inc. and that organization (including any data processing addendum) will govern in the event of a conflict with this Policy.

5. Legal Bases for Processing (EEA/UK Visitors)

Where the EU/UK General Data Protection Regulation applies, we process personal data on these bases:

  • Legitimate interests — operating and securing the Services, analytics, and responding to business inquiries (Art. 6(1)(f));
  • Consent — where required, for example for non-essential storage on your device (Art. 6(1)(a));
  • Contract — performing an agreement with you or taking steps at your request before entering one (Art. 6(1)(b));
  • Legal obligation — where processing is required by applicable law (Art. 6(1)(c)).

6. How We Share Information

We do not sell your personal information, and we do not share it for cross-context behavioral advertising. We disclose information only:

  • To service providers — hosting, cloud infrastructure, AI model providers, analytics, email and communications, payment processing (where applicable), and other technology vendors that process data on our behalf under contractual safeguards;
  • For legal reasons — when required by law, subpoena, or legal process, or to protect the rights, property, or safety of Magic Commerce Inc., our users, or the public;
  • In business transfers — in connection with a merger, acquisition, financing, or sale of assets, subject to this Policy;
  • With your direction or consent.

7. Confidentiality and Intellectual Property

  • No confidential relationship by default. Submission of information through the public Services does not by itself create a confidential relationship, non-disclosure agreement (NDA), or professional engagement with Magic Commerce Inc. Confidentiality obligations arise only under a signed written agreement.
  • Your property stays yours. Information, materials, and content you voluntarily submit remain the property of their respective owner unless otherwise agreed in writing.
  • Client content provided under a signed engagement is handled according to the confidentiality and data-protection terms of that agreement, which prevail over this Policy in the event of a conflict.

8. International Data Transfers

Magic Commerce Inc. is based in the United States, and information we collect is processed in the United States and in other countries where our service providers operate. Where required, we rely on appropriate safeguards for cross-border transfers, such as standard contractual clauses. By using the Services, you understand that your information may be transferred to jurisdictions that may have different data-protection rules than your own.

9. Data Retention

We retain personal information only as long as reasonably necessary for the purposes described in this Policy — typically, inquiry and chat records and identifiable analytics data for up to 24 months after the last interaction — unless a longer retention period is required to comply with legal, accounting, contractual, or regulatory obligations, or to establish, exercise, or defend legal claims. We may retain aggregated or de-identified data, which cannot reasonably identify you, indefinitely.

10. Security

We use commercially reasonable administrative, technical, and organizational measures designed to protect personal information, including encryption in transit (HTTPS), access controls, and monitoring. We regularly review our security controls and may update them as industry standards evolve. However, no method of transmission or storage is completely secure, and we cannot guarantee absolute security.

11. Your Rights and Choices

11.1 All Visitors

You may contact us at hello@magicco.ai to request access to, correction of, or deletion of personal information we hold about you. You can clear the visitor identifier at any time by clearing your browser's site data (see our Cookie Policy).

11.2 EEA/UK Visitors (GDPR)

You have the right to access, rectify, erase, restrict, or object to the processing of your personal data; the right to data portability; and, where processing is based on consent, the right to withdraw consent at any time without affecting prior processing. You also have the right to lodge a complaint with your local supervisory authority.

11.3 California Residents (CCPA/CPRA)

California residents have the right to know, access, correct, and delete personal information; the right to opt out of "sale" or "sharing" of personal information; and the right to non-discrimination for exercising these rights. We do not sell or share personal information as those terms are defined by the CCPA/CPRA, and we have not done so in the preceding 12 months. To exercise your rights, contact hello@magicco.ai with the subject line "Privacy Request." We will verify your request and respond within the timeframes required by law. You may designate an authorized agent to act on your behalf.

12. Do Not Track and Global Privacy Control

Because we do not track visitors across third-party websites or sell/share personal information, we treat all visitors the same regardless of Do Not Track or Global Privacy Control signals.

13. Children's Privacy

The Services are intended for business audiences and are not directed to children under 16. We do not knowingly collect personal information from children under 13. If you believe a child has provided us personal information, contact us and we will delete it.

14. Third-Party Links

The Services may link to third-party websites or services we do not control. This Policy does not apply to those third parties, and we are not responsible for their privacy practices.

15. Governing Law

This Privacy Policy shall be interpreted in accordance with the laws of the State of Florida and applicable United States federal law where appropriate, without prejudice to any additional protections granted to you by mandatory law in your place of residence (such as the GDPR or CCPA/CPRA).

16. Changes to This Policy

We may update this Policy from time to time, including as we launch new products and Services. The "Last updated" date above reflects the most recent revision. Material changes will be posted on this page, and your continued use of the Services after changes become effective constitutes acceptance of the revised Policy.
